Timothy Hill is a highly esteemed international arbitrator, based in Hong Kong, renowned for his exceptional track record in commercial dispute resolution spanning over thirty-five years. Since 1988, Tim has been a prominent figure in Hong Kong's legal community. He recently transitioned to a full-time neutral role after serving as a partner at Hogan Lovells and as the former Managing Partner of its Hong Kong office. Notably, he led the International Arbitration and Construction and Engineering Practice in Asia, showcasing his expertise in these sectors.

Tim's practice primarily focuses on the construction and engineering industry, handling a wide range of related commercial disputes. He has participated in over 150 mediations and arbitrations across Asia, Australia, Europe, and the Middle East. Tim has served as both a sole arbitrator and as a member of three-person tribunals, demonstrating his versatility and ability to effectively adjudicate cases under various institutional rules such as CIETAC, ICC, HKIAC, KLRCA, LCIA, SIAC, and UNCITRAL.

Tim is a Fellow of the Chartered Institute of Arbitrators and a Fellow of the Hong Kong Institute of Arbitrators. His skills as a mediator have also been formally assessed by the Accord Group, qualifying him to act as a sole mediator to facilitate dispute resolutions.

Tim has been involved in a wide range of construction disputes relating to issues affecting the successful structuring, award, and delivery of complex projects in a variety of industry sectors including building, construction, energy, information technology, insurance, and joint ventures.   His practice is broad and involved all types of parties including employers, main contractors, subcontractors (both domestic and specialist), consultants, and insurers. He has assisted a wide range of parties in respect of final account disputes, addressing valuation and time-related matters.  He has also considered most of the issues that arise through the supply chain whilst delivering projects.

Tim has extensive experience of commercial disputes across a number of industry sectors, including construction, energy, employment, information technology, insurance, joint ventures, sale of goods.  He has been involved in cases relating to design, supply and distribution of goods and services, contractual disputes across a range of industries, guarantee arrangements and joint venture agreements.

Tim has been involved in several disputes relating to issues in the Energy, Oil and Gas sector.  A number of these disputes related to the design, procurement, and construction of capital projects in the sector in respect of both onshore and offshore facilities.  He has also acted as counsel in respect of disputes under off take agreements and joint development agreements.

Tim has been involved in a wide range of disputes in the insurance sector, particularly in respect of general liability insurance, contractors all risk, delayed start up and professional indemnity.   His practice is broad and involved all key parties, including insured parties, insurers, and re-insurers.

Tim has advised and represented parties in a significant number of disputes arising from the management and resolution of disputes arising under contractual joint venture agreements and shareholder agreements.

Tim has advised and represented parties in several disputes relating to software development and systems integration, relating to telecommunications projects, infrastructure, and transportation.

Arbitrator

  • Appointed as Presiding Arbitrator in a reference under the UNCITRAL Arbitration Rules for the supply of steel governed by the law of Hong Kong and a related letter of credit.
  • Appointed as Presiding Arbitrator in two separate references relating to the provision of aircraft engineering and component overhaul work conducted under the UNCITRAL Model Law and governed by the law of Hong Kong. 
  • Jointly appointed by parties as the sole arbitrator in respect of an ad hoc reference arising under a sub-contract for the construction of a road, governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a dispute between a main contractor and statutory authority, relating to public works, conducted under the HKIAC Domestic Arbitration Rules (subject to amendment) and governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a final account dispute between a specialist subcontractor and main contractor under a form of nominated sub-contract, relating to a residential development, conducted under the HKIAC Domestic Arbitration Rules governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a dispute arising from a specialist sub-contract on a major building project, an ad hoc reference governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a commercial dispute arising from the development and manufacture of a board game, an ad hoc reference governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a dispute arising under a policy of insurance, an ad hoc reference governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a dispute for the supply of goods, under the UNCITRAL Arbitration Rules governed by English law.
  • Appointed as sole arbitrator in respect of a dispute arising under an Employees’ Compensation policy of insurance, an ad hoc reference governed by the law of Hong Kong.
  • Appointed as sole arbitrator in respect of a dispute arising under an Employees’ Compensation policy of insurance, an ad hoc reference governed by the law of Hong Kong.
  • Appointed as joint arbitrator (one of two) in respect of a dispute arising from a Construction Management Agreement, relating to a development near Shanghai, an ad hoc reference governed by the law of Hong Kong.

  • Counsel in mediation in respect of a major reclamation project in Hong Kong.
  • Counsel in mediation in respect of a tunnelling project in made ground which arose following inundation of the works.
  • Counsel in mediation in respect of a tunnel and related excavation works in respect of a rail project.
  • Counsel in various mediations arising from major infrastructure projects, including road, rail and airports, as well as various building projects, including in the resolution of disputes between joint venture participants.
