The start of 2025 has delivered three major setbacks for climate action: a disappointing hashtag#COP29 with inadequate outcomes on both finance and mitigation, Trump's aggressive anti-climate agenda backed by executive orders including the withdrawal from the hashtag#ParisAgreement, and the Shell climate litigation reversal in the hashtag#Netherlands. However, beneath these challenges, opportunities are emerging. Constitutional constraints limit Trump's executive power, while private coalitions are stepping in to ensure the US honours its climate commitments, and the Supreme Court has cleared the way for state-level climate damage lawsuits against fossil fuel companies.
Breakthrough rulings from the ECHR and pending ICJ advisory opinion may strengthen international climate obligations, and even the Shell ruling reinforces corporate duty of care and due diligence requirements.
This talk examines how these setbacks and opportunities are reshaping climate action, with particular focus on legal pathways to constrain hashtag#fossilfuel expansion and corporate #emissions.
