Arbitra members J. Brian Casey FCIArb and John Judge recently participated in the prestigious ICC Arbitration Advanced Arbitration Academy in Toronto.

This two-day workshop focused on Evidence and Hearing, engaged participants in discussions about practical issues arbitrators face when dealing with evidence and managing hearings. On 25 April 2024 the second edition of the Civil Law Conference took place in Abu Dhabi.

From engaging discussions to insightful presentations, the conference brought together legal professionals, esteemed professors, students, and legal enthusiasts to explore the dynamic landscape of civil law.

This year, the focus was on the Change of circumstances and the contract in civil law: flexibility or uncertainty? Pacta sunt servanda: Is the contract always the law of the parties? Congratulations to Lara Hammoud and Carine Dupeyron for putting together an incredible programme and acclaimed speakers list once again!

Alex Wilbraham spoke at the Harvard Law School Brazilian Studies Association event which took place on 13 and 14 April.

Joined by Fabiano Robalinho Cavalcanti, Lucy Reed, and Natalie Reid with the session being expertly moderated by Julia Grabowsky Basto Fleichman this event provided a riveting discussion on 'A Dialogue Between Arbitrators and Practitioners in International Arbitration'.

On April 4 Frank Lattal, FCIArb was a guest lecturer at the Keough School of Global Affairs at the University of Notre Dame. He addressed a Diplomacy class.

Frank's topic was International Dispute Resolution and Negotiation.

Frank is also an Advisory Board member at the Nanovic Institute for European Studies at Notre Dame .

Registration now open! Second Edition - Civil Law Conference: Change of circumstances and the contract in civil law: flexibility or uncertainty?

Join us for the second edition of the civil law conference as we delve into the pivotal topics of the theory of imprévision and the intervention of the judge in civil law contracts.

Explore the intricate balance between the theory of pacta sunt servanda and the authority granted to judges to intervene in specific circumstances in the parties’ agreements. Engage with experts and hear comparative approaches with respect to the theory of imprévision and the judicial intervention in case of non-performance of the contract by a party.  

Law professors, judges and practitioners from the MENA region and other civil law jurisdictions will provide insight into how these topics are implemented in various civil law jurisdictions. 

Both civil law and common law professionals, from the private and public sectors, in-house and outside counsel would benefit from and contribute to a comparative discussion on these fundamental concepts. The discussion will be led both on theoretical and practical levels by eminent academics and practitioners.

Sunil Abraham and Cecil Abraham attended the International Bar Association 25th Annual IBA Arbitration Day in #Singapore

Paul Sills participated on panel at the Decipher and Desimone Seminar, which took place at the IDRC.

During Paul Sills' presentation, he successfully reshaped the audience's perspective on arbitration. Initially regarded as the least useful form of ADR mechanism, Paul's insights and expertise completely altered the room's perception, leading to a unanimous consensus that arbitration is now recognised as the most effective approach.

Eun Young Park, an esteemed Independent Arbitrator, was a guest speaker at the 10th Harvard Law School International Arbitration Conference, which took place on 2 February 2024.

Dr. Eun Young Park will participate on the panel "Cultural Sensitivity and Diversity in International Arbitration” where he shared the stage with other distinguished speakers including Dorothy Udeme Ufot, SAN, Elisa Zavala Achurra, Mary (Meg) Utterback, Annie Lespérance, FCIArb and session moderator Kyongwha Chung.

Calvin A. Hamilton, C.Arb. FCIArb spoke at the Institute for Transnational Arbitration America’s Initiative faculty which took place in the Cayman Islands on 29 January.

Over the past 30 years, Latin America has made significant strides in commercial arbitration, with legislative and judicial improvements, while the Caribbean is now working to modernise its arbitration practices. However, challenges remain in education, legal frameworks, capacity building, and support.

The ITA Americas Initiative's Caribbean Task Force shared findings and recommendations for Caribbean arbitration development and discussed lessons learned and practical steps for advancement, with the ITA's assistance.
